EU published corrections on the regulations of use of BPA in food contact articles

Regulation (EU) 2026/250 corrects BPA Regulation 2024/3190, clarifying the transition periods of repeat-use article sell-through to 2027/2029, removing "salts" from BPA definition, and clarifying DoC for intermediate materials. Effective February 23, 2026.
On February 2, 2026, the European Commission released Regulation (EU) 2026/250, a targeted legal measure aimed at rectifying specific inaccuracies found in the significant Regulation (EU) 2024/3190.
The original version of Regulation (EU) 2024/3190 contained several errors that posed risks of inconsistent enforcement among Member States and led to confusion regarding compliance timelines.
One of the key corrections made pertains to the transitional periods for repeat-use final food contact articles. The amendments aim to correct the maximum 12 months period for the articles to remain on the market. These articles, made with BPA and compliant with earlier regulations, are permitted to remain on the market until July 20, 2027. Similarly, repeat-use final food contact articles used in professional food production that also meet previous regulatory standards can stay available until January 20, 2029.
Additionally, the ban on BPA has been revised, removing the phrase “and its salts” to better align with the definition of bisphenol. Furthermore, Point 3 of the declaration of compliance in Annex III has been amended to specify the identity of the intermediate food contact materials or final food contact articles.
These corrections will take effect on February 23, 2026.
